Why some parents refuse to pay child support

"Failure to support a child -- you bet it's criminal. So is denying a child visitation with the other parent, parental alienation and parental abduction. The major difference is that when one doesn't pay child support, there are records and it can be monitored and penalized. When a parent subtly instills alienation in a child toward the absent parent, misuses the support money and fails to provide for the child, it is much more difficult to recognize. The parent who receives child support should be held just as accountable as the parent who pays child support."

Relatives Are Not Protected By DCF or the State From Lawsuits. In a recent trial court opinion issued by the Superior Court in Hudson County, Judge Gallipoli recognized that parents in NJ may have a right to collect damages for intentional infliction of emotional distress when their relationships with their children are poisoned by former spouses or even grandparents who partake in alienating behaviors.

Children’s Rights Initiative for Shared Parenting (CRISP)

CRISP is a Non Governmental Organization(NGO) founded recently by a group of citizens, who recognize the serious effects of “parental alienation” on children due to single parent families on account of divorce or sepafration. CRISP also focuses on furthering the rights of a child to remain connected with both parents in case parents get divorced. While most NGOs pertaining to children deal with issues related to child labour, education etc we deal with issues related to unquestionable right of children to be cared for by both biological parents.

Parental Alienation Syndrome - The Problem

In spite of the divisiveness that has evolved around this topic, one issue that few will debate is the fact that too many children are caught in a “tug of war” between their separated parents.

Northwest Territories passes motion in support of equal parenting and Vellacott’s Motion M-483

OTTAWA – The Northwest Territories has demonstrated its pioneering spirit by paving the way for equal parenting in Canada. Guided by the leadership of Kam Lake MLA David Ramsay, the Legislature of the Northwest Territories, on June 19, passed a motion to affirm the importance of "equal parenting" as in the best interests of children even in cases of marriage breakup and family dissolution. This guiding principle of course recognizes exceptions in cases of proven child abuse or neglect. In speaking to his motion, Ramsay said, "I believe strongly that both parents should be involved in the upbringing of a child. If you look around the world, the movement is going to a default system of equal, shared parenting so that both parents in separation and divorce have equal access to children."

Experience in UK family law

* Lady Justice Hale (in Re K (Contact: Psychiatric Report) [1995] 2 FLR 432) stated: It is my unhappy experience, borne out by other anecdotal evidence and confirmed by the Official Solicitor's department that there seems to be an increasing number of cases coming before the family courts where contact between a young child and the absent parent has become bedevilled by stubborn opposition to contact being shown by the child which may, or may not, be evidence of some implacable hostility on the part of the other parent for good reason or for no reason at all.

Lady Elizabeth Butler-Sloss, President of the Family division, (the top UK family court judge) stated (in Re L, V, M, H (Contact: Domestic Violence) [2002] 2 FLR 334 at 351): There is, of course, no doubt that some parents, particularly mothers, are responsible for alienating their children from their fathers without good reason and thereby creating this sometimes insoluble problem. That unhappy state of affairs, well known in family courts, is a long way from recognised syndrome requiring mental health professionals to play an expert role.

Shared Parenting Should be Law

Shared parenting is not currently law due to ideological extremist in the Democratic Party; it is a radical element that call themselves “feminist” but know nothing of the meaning of the term. Instead of embracing gender equality, these “feminists” oppose it in our family courts and embrace outdated stereotypes of women as homemakers and men as breadwinners. They are not above lying. They have repeatedly claimed that shared parenting would end case-by-case determinations, or make the results of custody disputes “automatic” though this can simply be disabused by reading the plain words of the proposed statute.

Hostile Aggressive Parenting

Brown has seen it all: judges who aren’t up to date on the facts of domestic violence, and so base rulings on myths and stereotypes; a “disconcerting proportion” of judges who don’t know the law they are supposed to be applying or don’t care to apply it when they do know; judges who ignore evidence, affidavits and expert testimony that favour the father; judges who defer “difficult” (i.e., mother-unfriendly) decisions until it is too late; judges swift to punish fathers for support payment lapses, but loath to impose consequences on mothers who flout access orders.
